Terms of Service

1) Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of BnbDirect ("BnbDirect," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2) Who We Are

BnbDirect is a United States–based software service that helps short‑term rental hosts generate and manage self‑hosted booking websites from their listing data.

3) Eligibility & Business Use

• You must be at least 18 years old and able to form a legally binding contract. This requirement reflects payment processing rules (e.g., Stripe account obligations) and the business nature of hosting activities.
• The Service is intended for business/creator use by hosts managing their own listings. You are responsible for complying with all laws and third‑party terms that apply to your hosting activity.

4) Accounts

• Provide accurate, current information and keep your credentials secure.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized use or security incident.

5) Services & Relationship to Airbnb

• BnbDirect provides tools to generate and manage self‑hosted booking sites based on your listing data.
• No affiliation: BnbDirect is not affiliated with or endorsed by Airbnb, Inc. or any other marketplace.
• You are solely responsible for your listing content, accuracy, availability, pricing, house rules, and guest communications.
• We are not a party to any agreements between you and your guests and do not broker, manage, or guarantee bookings.

6) Your Content & License to Us

• You retain ownership of your content (e.g., listing text, photos, pricing, availability).
• You grant BnbDirect a non‑exclusive, worldwide, royalty‑free license to host, copy, transform, and display your content as reasonably necessary to operate and improve the Service.
• You represent that you have all rights necessary to use and provide the content and that it does not infringe any third party’s rights or violate applicable law or platform terms.

7) Payments & Billing (Subscriptions Only)

• Access to BnbDirect requires a paid subscription. Current fees are listed on our Pricing page and may change from time to time.
• Payments are processed by Stripe. By subscribing, you authorize us (and our payment processor) to charge your payment method for recurring fees.
• Fees are billed in advance and renew automatically unless you cancel before the next billing date. You can cancel at any time in your account settings; cancellation prevents future charges.
• Scope: Subscription fees cover use of the BnbDirect software only. We do not process, collect, or settle payments between you and your rental guests.
• Except where required by law, fees paid are non‑refundable.

8) Self‑Hosted Deployments & Third‑Party Services

• You may connect or deploy to third‑party services (e.g., your hosting provider, domain registrar, analytics). Those services are governed by their own terms and privacy policies. We are not responsible for third‑party services.
• Availability, performance, and data retention can depend on third‑party systems over which we have no control.

9) Prohibited Uses

• Illegal or deceptive activity, including false listings or fraud.
• Infringement of intellectual property or violation of third‑party/platform terms.
• Security violations, scraping beyond permitted use, or disrupting the Service.

10) Service Availability; Changes

• We may modify or discontinue features at any time with or without notice.
• From time to time, we may release beta or preview features; such features are provided “as is.”

11) Suspension & Termination

• We may suspend or terminate your access for violations of these Terms, nonpayment, or risk of harm to the Service.
• Upon termination, your license ends and you must cease use of the Service. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability, indemnities) will survive.

12) Disclaimers

The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation.

13) Limitation of Liability

To the maximum extent permitted by law, BnbDirect and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, whether incurred directly or indirectly. Our total liability for any claim relating to the Service is limited to the amounts you paid to BnbDirect in the three (3) months preceding the event giving rise to the claim.

14) Indemnification

You will defend, indemnify, and hold harmless BnbDirect from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your content, your use of the Service, or your violation of these Terms or applicable law.

15) Privacy & Data Protection

• Our collection and use of personal information is described in our Privacy Policy.
• If you are located in the European Union or California, you may have additional rights under GDPR/CCPA (e.g., access, deletion). We honor such rights as described in our Privacy Policy.

16) Governing Law & Venue

These Terms are governed by the laws of the United States and the State of [Your State], without regard to conflict of laws rules. The courts located in that state will have exclusive jurisdiction over disputes arising from these Terms or the Service, and you consent to such jurisdiction and venue.

17) Changes to These Terms

We may update these Terms from time to time. If a change is material, we will provide notice (for example, by email or in‑app notification). Your continued use of the Service after changes become effective constitutes acceptance.
